Terms & Conditions for The 4 Percent

Welcome to The 4 Percent (“we,” “us,” “our”). These Terms govern your membership and use of our platform. By signing up for a membership, you agree to these Terms.
1. Membership & Access
1.1. We offer four membership tiers: Core, Community, Creator, and Founding Member. Each tier grants access to specific plugins and services as described at the time of purchase.
1.2. Membership may be purchased as Monthly, Yearly, or Lifetime, depending on the tier selected.
1.3. Founding Member is available as either a one-time payment or a 6-month installment plan. Lifetime access is granted only upon completion of all payments.
1.4. All members receive a dashboard to manage their profile and subscription.
1.5. You must be at least 18 years old to purchase a membership.
2. Software Updates & Upgrades
2.1. The plugins are currently in active development and may contain bugs or issues. We are committed to ongoing improvements.
2.2. Active members receive:
- Software updates (bug fixes, security patches, stability improvements)
- Upgrades (new features and major versions)
2.3. Upon cancellation or non-payment:
- You will continue to receive software updates (bug fixes, security patches, stability improvements) to ensure the software functions as intended
- You will not receive upgrades (new features or major versions)
- You may continue using the software indefinitely
2.4. Founding Members receive all updates and upgrades to all current and future plugins in perpetuity.
3. User-Generated Content
3.1. Members may create and publish content (including templates, prompts, and profile information) on the platform.
3.2. You retain all ownership rights to content you create. The 4 Percent acts solely as a publishing platform.
3.3. By publishing content, you grant us a non-exclusive license to display, distribute, and promote your content on the platform.
3.4. You are solely responsible for ensuring your content complies with all applicable laws and does not infringe on third-party rights.
3.5. We reserve the right to review, moderate, or remove content that violates these Terms or applicable laws.
3.6. Upon cancellation, you may request to:
- Have your content and profile deleted immediately, OR
- Have your content remain on the site for an agreed period as part of your exit strategy
4. Payment & Billing
4.1. Monthly and Yearly memberships renew automatically until cancelled.
4.2. All fees are in USD or ZAR as selected at checkout.
4.3. You are responsible for all applicable taxes.
4.4. Prices are subject to change. Current members will be notified 30 days before any price increase affects their renewal.
5. Cancellation & Refunds
5.1. You may cancel at any time by contacting allison@violetportal.blog or via your dashboard.
5.2. No refunds are provided for any membership payments. Demos and detailed information are available to help you determine fit before purchase.
5.3. Upon cancellation, access continues until the end of your current billing period.
5.4. For Founding Member 6-month plans: If cancelled before completing all 6 payments, lifetime access is not granted.
6. Prohibited Conduct
You agree NOT to:
6.1. Use the platform for any illegal purpose or in violation of any laws
6.2. Attempt to gain unauthorized access to the platform, other accounts, or computer systems
6.3. Transmit viruses, malware, or any malicious code
6.4. Harass, abuse, or harm other users
6.5. Spam, phish, or engage in fraudulent activity
6.6. Resell, redistribute, or share access to your account or the plugins
6.7. Reverse engineer, decompile, or attempt to extract source code from the plugins
6.8. Remove or modify any proprietary notices from the software
7. Intellectual Property
7.1. All plugins, software, templates, and content provided by The 4 Percent remain our intellectual property.
7.2. You are granted a non-exclusive, non-transferable license to use the software for the duration of your active membership.
7.3. Our trademarks, logos, and brand elements may not be used without express written permission.
8. Platform Availability & Development
8.1. The 4 Percent is in active development. Early members are part of the co-creation process. Some technical issues may occur.
8.2. We strive to maintain platform availability but do not guarantee uninterrupted access.
8.3. We reserve the right to modify, suspend, or discontinue any aspect of the platform with reasonable notice.
8.4. Additional features may be added in the future. Whether new features are included in existing memberships will be decided on a case-by-case basis, except for Founding Members who receive all new plugins automatically.
8.5. We are not liable for any downtime, data loss, or technical issues.
9. Third-Party Services & Links
9.1. The platform may contain links to third-party websites or services that are not owned or controlled by The 4 Percent.
9.2. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
9.3. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.
10. Privacy & Data Protection
10.1. Your use of the platform is also governed by our Privacy Policy, available at [link to privacy policy].
10.2. By using the platform, you consent to the collection and use of information as described in our Privacy Policy.

11. Communications
11.1. By creating an account, you agree to receive communications from us including:
- Transactional emails (receipts, account updates)
- Service announcements
- Product updates and newsletters (you may opt out of marketing communications)
11.2. We will primarily communicate via the email address associated with your account.
12. Limitation of Liability
12.1. THE PLATFORM AND PLUGINS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
12.2. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
12.3. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
12.4. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify and hold harmless The 4 Percent, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any rights of another party
- Content you publish on the platform
14. Termination
14.1. We reserve the right to terminate or suspend your account immediately, without prior notice, for violation of these Terms.
14.2. Upon termination for cause, all licenses and access rights cease immediately and no refunds will be provided.
14.3. Sections that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Modifications to Terms
15.1. We may modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date.
15.2. Material changes will be communicated via email or prominent notice on the platform.
15.3. Continued use after changes constitutes acceptance of the modified Terms.
15.4. If you do not agree to the modified Terms, you must cancel your membership.
16. Dispute Resolution
16.1. Governing Law: These Terms are governed by the laws of South Africa, without regard to conflict of law principles.
16.2. Jurisdiction: Any disputes shall be resolved exclusively in the courts of South Africa.
16.3. Informal Resolution: Before filing any formal claim, you agree to attempt to resolve disputes informally by contacting us at allison@violetportal.blog.
17. General Provisions
17.1. Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and The 4 Percent.
17.2. Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17.3. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
17.4. Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
17.5. Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control.
18. Onboarding
New members are invited to group onboarding sessions to learn how to use the system and maximize the value of their membership.
